real_aurgathor Although I have no legal qualifications whatsoever, I would expect that it doesn't matter where you are when you download infringing content. This is made worse in this case by the fact the copyrighted data are being ingested into a model that can then be induced to regurgitate that content verbatim once it is in production use, and often without even so much as a citation. As far as I'm concerned, there should be no question about it; they are guilty and liable and Mark, Sam, Elon et al should have their chequebooks handy.
It's simple; if they are (or will be) making money with these models, then they should and always fully expected to have to pay for the content that said models ingest. They will ultimately either pay per use (each regurgitation) or acquire an ongoing license for said content, with recurring royalties. Anything less is theft and just plain wrong. End of discussion.
Clearly, they're trying to get away with it, but how long will that last? Even the current administration in the United States can't give them a complete pass, unless the companies in question only operate in the United States, and only ingested U.S.-origin content. Even if the authors or other content creators don't get a favourable ruling in the U.S. now, sooner or later someone will file claim against them in a jurisdiction where they are not so likely to get away with their misdeeds.
