Fences are usually not meant to be climbed, and one tourist in Italy learned that in a very pointed, direct, and personal lesson.
An American tourist’s visit to the Colosseum in Rome took a turn for the terrifying after the man impaled himself on a fence and was left dangling and screaming in pain, while other visitors looked on in horror, according to Italian news outlets.
The man fell and was skewered by the sharp metal bars of the fence. He began screaming and bleeding profusely until he became unconscious, the newspaper reported.

I’m not a lawyer but he can most certainly sue for having unsafe, sharp metal bars in that fence, and possibly having a “No climbing on or over fence” sign, though Italian courts may not be as ‘understanding’ as US courts.
I couldn’t find a picture or video of him being impaled, [even though I expect that at least half of the onlookers should’ve been recording it], only a picture of the type of fencing he may have gotten impaled on. (picture in below link)
